The Lehigh County Humane Soceity is a Section 501(c)3 entity that was founded in 1906 to provide a haven for homeless animals and for the prevention of cruelty to both animals and children. During the following year, the Commonwealth of Pennsylvania officially incorporated the Humane Society as a nonprofit organization. A member of that founding board was Jessie Dent, the great-grandmother of our present day Congressman Charlie Dent. There is insufficient evidence to establish that the Humane Society is controlled by any government agency or entity. The Humane Society’s Board is not appointed by a government entity or official and is not controlled by any municipality or local government. The Humane Society is an independent entity and there is no evidence that the Commonwealth, or any local government entity has control over the Humane Society’s assets or its day to day operations. A public record that is not in the possession of an agency but is in the possession of a party with whom the agency has contracted to perform a governmental function on behalf of the agency, and which directly relates to the governmental function and is not exempt under this act, shall be considered a public record of the agency for purposes of this act.
