NASCAR: Jeremy Mayfield hearing delayed
The U.S. Court of Appeals has rescheduled the Nov. 8 hearing for suspended driver Jeremy Mayfield's appeal in his case against NASCAR. The court cited "scheduling reasons" for taking the case off the Nov. 8 docket but didn't offer details. The former owner/driver is suing NASCAR for breach of contract, defamation and unfair trade practices.
Mayfield has not competed in NASCAR since failing a drug test in May 2009. NASCAR said a random test came up positive for methamphetamines; Mayfield says it was a false positive from a combination of prescription medication for attention-deficit-hyperactivity disorder and over-the-counter allergy medication.
The case likely won't be heard until Dec. 6-9, although it could move to Oct. 25-28. A three-judge panel will decide whether Mayfield has enough evidence for his case to continue.
In May 2010, Judge Graham Mullen dismissed the claims and said Mayfield could not sue NASCAR because of waivers he signed to compete in Sprint Cup. The judge also questioned the strength of Mayfield's evidence.
